Terms of Service

1. Agreement to Terms

By accessing or using tinypose (“the Service”), operated at tinypose.co, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

tinypose is an independent AI-powered newborn portrait service. Users upload photos of their baby, select a pose, and receive AI-generated portraits styled after professional newborn photography. The Service is provided on a per-purchase basis with tiered pricing (Free, Starter, Premium).

tinypose is an independent product built on top of third-party AI models. tinypose is not affiliated with, endorsed by, or sponsored by any underlying AI model provider. We use these models as tools to deliver our portrait generation service.

3. Eligibility

You must be at least 18 years of age to use the Service. By using tinypose, you represent that you are the parent or legal guardian of the child depicted in the uploaded photos, or that you have explicit consent from the parent or legal guardian.

4. User Accounts

You may sign up using Google authentication. You are responsible for maintaining the security of your account. You agree to notify us immediately of any unauthorized use of your account.

5. Uploaded Content

• You retain full ownership of the photos you upload to tinypose.
• By uploading photos, you grant tinypose a limited, non-exclusive license to process your images solely for the purpose of generating your portraits.
• We do not use your photos to train AI models.
• Uploaded photos are encrypted at rest and deleted immediately after your portraits are generated.

6. Generated Portraits

Portraits generated by the Service are AI-created images. You receive a personal, non-exclusive license to use your generated portraits for any personal, non-commercial purpose (printing, sharing, social media, etc.). You may not resell or commercially distribute the generated portraits.

7. Payments & Pricing

• Payments are processed by Creem. Creem handles all payment processing, tax collection, and compliance.
• Prices are displayed in US dollars (USD). Applicable taxes are calculated and added at checkout.
• Purchases are one-time payments, not subscriptions. There are no recurring charges.
• Free tier users receive watermarked preview portraits. Paid tier users receive full-resolution portraits without watermarks.

9. Prohibited Uses

You agree not to:

• Upload photos of children without parental or guardian consent.
• Use the Service to create, attempt to create, or upload any explicit, sexually suggestive, pornographic, or NSFW content.
• Use the Service to create harmful, exploitative, abusive, hateful, violent, or deceptive content of any kind.
• Use generated images to impersonate, deceive, defraud, or mislead others.
• Attempt to reverse-engineer, scrape, or interfere with the Service.
• Use the Service for any unlawful purpose.

Your use of the Service is also governed by our Acceptable Use Policy, which provides additional detail on permitted and prohibited conduct.

10. Intellectual Property

The tinypose brand, website design, pose templates, and documentation are owned by tinypose. You may not copy, reproduce, or distribute any part of the Service without permission.

11. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee that every generated portrait will meet your expectations. AI-generated images may occasionally contain imperfections.

12. Limitation of Liability

To the maximum extent permitted by law, tinypose shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last updated” date. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of Amsterdam, the Netherlands.
